Supreme Court stays decision to increase number of local levels

The Supreme Court on Friday told the government not to implement its decision to increase the number of local levels in Terai region.

A division bench of Justice duo Sapana Malla Pradhan and Ishwar Prasad Khatiwada decided to stay the decision citing such a decision could be taken only in accordance with Article 295 of the constitution.

Sub-article 3 of Article 295 says, “The Government of Nepal shall constitute a commission for the determination of the number and boundaries of Village Bodies, Municipalities and Special, Protected or Autonomous Regions.”

Earlier this week, the government had decided to add 22 more local levels in Terai region and promote Birgunj and Biratnagar to the status of metropolitan cities in a bid to convince agitating Madheshi Morcha for local level elections.

Dhan Bahadur Shrestha among three had filed a petition against the decision.

Advocates Shambhu Thapa, Tikaram Bhattarai and Ramesh Badal among others had advocated against the decision during the hearing today.
