New law will allow local, provincial govts to impose penalties regarding administrative affairs

The National Assembly is currently discussing a new draft law, which, if implemented, will allow local and provincial governments also to impose penalties and fines on offences regarding administrative affairs except those related to the criminal law.

As the constitution has assigned the sub-national governments to govern various issues such as education and health, the new law will allow the respective governments to introduce provisions of penalties and fines in the laws to be formulated to govern the sectors. The Legislation Management Committee in the Upper House recently made an agreement regarding this.

In the draft of the bill regarding interrelation among the federation, province and local units, the federal government, however, had said the local and provincial governments would not be allowed to formulate any law that involves imprisonment. “But now, the provincial governments can introduce such provisions within their jurisdiction,” the committee’s secretary Manoj Kumar Giri informs.

Meanwhile, the new law will also allow the provincial and local governments to take action, such as demotion, against government employees.
