Nembang says Deuba can’t sack Maoist ministers without Dahal’s decision

Kathmandu, October 6

CPN-UML leader Subas Chandra Nembang says Prime Minister Sher Bahadur Deuba cannot sack ministers representing the CPN-Maoist Centre with the party Chairman Pushpa Kamal Dahal’s decision to do so.

Nembang’s comment responds to media reports that some Congress leaders have suggested that PM Deuba remove the Maoist ministers as their party already lost moral high grounds to be a part of the government as it decided to unify with the main opposition.

But, Nembang, who led the constitution writing process as the Chairman of then Constituent Assembly, says the respective party chair’s decision is a must to remove members from the Cabinet as per Article 298.9 of the constitution.

The provision says the ministers get relived of their office if they resign, if the PM quits or is removed, if they die or if the respective party recommends.

Nembang further claims the removal of ministers will also violate the election code of conduct and the Election Commission may stay the decision.
