Kulman Ghising files petition to challenge unlawful dismissal

In a bold move, Kulman Ghising, the former Executive Director of Nepal Electricity Authority (NEA), has approached the Supreme Court challenging his recent dismissal, claiming it was unlawful.

His petition, which was registered with the court on Thursday, demands that the government’s decision be overturned and that he be reinstated in his previous position.

In the petition, Ghising alleges that his removal was executed without valid reasons or proper justification, claiming that the government acted in bad faith. He points out that he had not committed any errors or misconduct that would warrant such a drastic action. Ghising is seeking legal intervention to nullify the government’s decision, which he believes was politically motivated.

The petition names several parties as defendants, including the Prime Minister’s Office, the Ministry of Energy headed by Minister Deepak Khadka, the NEA’s Board of Directors, and the newly appointed Executive Director, Hitendra Dev Shakya.

In his petition, Ghising argues that the government’s actions were based on ill intentions, accusing them of asking for a clarification without valid grounds and subsequently removing him inappropriately. He emphasises that he has been wronged and insists on his right to be reinstated.

The Supreme Court has set a date for the initial hearing of the petition, which is scheduled for Friday (March 28), marking the beginning of a legal battle that could have significant implications for the energy sector in Nepal. Ghising’s removal from NEA has stirred political and public debate, and this legal action now places the matter squarely in the hands of the judiciary.
