Writ petition against controversial ordinance being heard at SC

Kathmandu, January 1

The writ petition against the controversial ordinance on the working procedure of the Constitutional Council is being heard at the Supreme Court on Friday.

President Bidya Devi Bhandari’s office, on December 15, issued an ordinance to amend the Constitutional Council (Functions, Duties, Power and Procedure) Act-2010. The amendment stated the council could hold a meeting if they had a majority present (three members including the Prime Minister).

Previously, it was stated that four of the six members had to be present in the meeting including the Prime Minister, who is the chair of the council.

The petition was filed by Senior Advocate Dinesh Tripathi and Advocate Om Prakash Aryal on December 16 and December 21 where they demanded both the ordinance and the ensuing decision of the Constitutional Council based on it be scrapped as both were unconstitutional and illegal.

A bench of Chief Justice Choledra Shumsher Rana, Meera Khadka, Hari Krishna Karki, Vishwombhar Prasad Shrestha and Sapana Pradhan Malla is hearing the petition.
