Judicial Council says Karki’s recommendation for new CJ invalid

The Judicial Council says it cannot accept the names recommended by retiring Chief Justice Sushila Karki for her successor.

Karki, who had headed the Judicial Council at the Chief Justice, had made the recommendation after the Council could not hold the meeting on time.

She had sent a letter to the Constitutional Council mentioning the names of justices Gopal Parajuli, Deepak Raj Joshi, Om Prakash Mishra, Devendra Gopal Shrestha, Cholendra  Shamsher Rana and Jagadish Sharma Paudel.

But, a member of the Judicial Council says names sent without holding the meeting cannot be accepted.

“There is no point in sending the names personally,” the member says, “As a journalist, you can also send such personal letters.”

Further, some Judicial Council members say Karki did not take any initiative to hold a meeting to endorse the recommendation.

Now, the Judicial Council will hold a meeting under the leadership of Acting Chief Justice and the meeting will recommend names to the Constitutional Council, according to the member.

Article 129 of the constitution provisions that the President appoints the CJ upon recommendation from the Constitutional Council.

Article 284, however, requires that the Constitutional Council should make such a recommendation a month before the post being vacated.
