The Supreme Court on Friday told the government to release Chudamani Sharma, who is in judicial custody after being charged of embezzlement.
Responding to a habeas corpus writ filed by Kalpana Upreti Sharma, wife of suspended chief of Inland Revenue Department, a full bench comprising five justices made the order.
The bench of Deepak Raj Joshi, Deepak Kumar Karki, Kedar Prasad Chalise, Sharada Prasad Ghimire and Anil Kumar Sinha says further hearing on the writ will continue after his release.
Earlier, responding to the writ, the apex court had told Commission for the Investigation of Abuse of Authority to transfer him to a judicial custody.
The CIAA has filed a corruption case against Sharma at the Special Court last claiming he along with two others embezzled Rs 10.02 billion from the state coffers while they were at the Tax Settlement Commission.
