Supreme Court denies stay order on Raya Yadav’s candidacy cancellation

The Supreme Court on Wednesday denied issuing an interim order in relation to the Election Commission’s decision to cancel the nomination of CPN-Maoist Centre candidate for House of Representatives in Sarlahi-4, Shiva Pujan Raya Yadav.

It means the Commission’s decision will be valid till the final verdict on the case. Now, the leftist alliance does not have any candidate in the constituency for the polls to be held tomorrow.

A division bench of justices Deepak Raj Joshi and Dambar Bahadur Shahi handed down the decision that the stay order was not necessary.

Earlier, the Commission had cancelled the leftist alliance’s candidate‘s nomination citing he was not qualified to contest the polls as he was convicted of misusing his diplomatic passport around two and half years ago by the Special Court. He was a member of the Constituent Assembly then.

However, Yadav had challenged the decision at the court.

The Court had asked the Commission to furnish it with reasons behind the decision yesterday.
