Minister for Law, Justice and Parliamentary Affairs Bhanubhakta Dhakal says the new NHRC Act adheres to the provisions of the new constitution.
Minister Dhakal, who was addressing a meeting of Parliament’s Law, Justice and Human Rights Committee, said that the Article 158 (2) of the constitution says that all cases in which the government is the plaintiff shall be handled by the Attorney General.
Dhakal’s comment come as the government faces criticism for giving the attorney general the final say over whether the National Human Rights Commission can bring any legal case or not. Critics argue that this provision reduces the power of the rights body and undermines its functionality.
“Even if we wanted to, we cannot even say that that the attorney general will recommend and the human rights commission will implement the recommendations; the constitution does not allow this,” he added.
