The Supreme Court has dismissed a writ petition filed against former Chief Justice Cholendra Shumsher Rana. With the Constitutional Bench’s ruling, the way has been cleared for Rana to receive pension benefits and other facilities.
Rana, who retired while suspended following an impeachment motion, had not received pension benefits or other facilities. A Constitutional Bench comprising Chief Justice Dr Manoj Kumar Sharma and justices Sapana Pradhan Malla, Kumar Regmi, Saranga Subedi and Binod Sharma decided to dismiss the writ petition against Rana.
Rana had retired as chief justice while an impeachment motion against him was pending. The term of the House of Representatives also ended before the impeachment motion against him could be concluded. Subsequently, Federal Parliament Secretary-General Bharat Raj Gautam sent a letter to the Supreme Court stating that Rana’s suspension would be lifted.
The Nepal Bar Association and Supreme Court Bar Association filed a writ petition challenging the letter. Following an immediate hearing, the Supreme Court’s Constitutional Bench issued an interim order preventing the implementation of the letter issued by the Federal Parliament Secretariat.
Rana has remained suspended until now because of the interim order.
