The government has filed a lawsuit at Kathmandu District Court against music company Sagarmatha Digital Pvt. Ltd., alleging that the copyright of two songwriters was infringed.
The Office of the Government Attorney, Kathmandu, filed two separate copyright-related cases against the company, seeking 9.5 million rupees in damages and other compensation.
According to the charge sheet filed by the Government Attorney’s Office, the company is accused of infringing the copyright of songwriters Saroj KC and Shashi Sharma Majgaiyan. The complaint seeks damages of 3.5 million rupees for KC and 6 million rupees for Majgaiyan.
The two songwriters have accused the company’s director, Hira Bahadur KC, of taking unauthorised control over their songs, using and commercially exploiting them without permission, and concealing income earned from their creative work, amounting to fraud. The case was filed following an investigation into their complaint.
Songwriter KC stated in his complaint that the company failed to disclose any earnings from several songs he wrote, including one referenced in the complaint, claiming there was no income at all, and that he had repeatedly been deceived and defrauded.
Songwriter Majgaiyan stated in his complaint that several songs he wrote were used and controlled without his permission, and alleged that the accused company earned income from them without authorisation. He has sought damages and compensation on that basis.
In this case, the Government Attorney has recommended that the defendant be punished according to law, in line with the complainants’ demands.
