Businessman Shankar Agrawal, who had been ordered released on bail by the Supreme Court, has been sent to custody by the Special Court.
A bench of Supreme Court justices Balkrishna Dhakal and Nrip Dhwaj Niraula had ordered Agrawal’s release on bail of Rs 1 million in a banking offence case.
On September 16, the bench overturned the detention order issued by the Patan High Court and ordered Agrawal’s release on bail.
However, a joint bench of Special Court chairperson Basudev Acharya and members Hemant Rawal and Bidur Koirala on Tuesday ordered that Agrawal be kept in custody while the case proceeds to trial.
In its order, the Supreme Court had said there was no direct evidence of Agrawal’s involvement in the alleged offences. It also took his age and health condition into consideration while ordering his release.
The Supreme Court further noted that Agrawal had not signed the documents related to the disputed loan and that there was no evidence of his direct involvement in decisions concerning the purchase of land and payment of advance money.
