Supreme Court orders House not to move impeachment motion

The Supreme Court of Nepal on Friday ordered the Parliament Secretariat to halt proceedings regarding an impeachment motion filed against Chief Justice Sushila Karki.

It also ordered Karki to end her suspension and resume work from today itself.

Responding to a writ filed against the move of Nepali Congress and CPN-Maoist Centre lawmakers, a single bench of Justice Cholendra Shumsher JB Rana made the interim order today.

Observing that the motion was not brought in line with the spirit of the constitution, the bench ordered the defendants to halt all the proceedings till the final verdict on the case.

It also observed that the charges filed against the Chief Justice were not based on evidence.

Hence, the bench told the defendants including the Parliament Secretariat to submit a written explanation to the court over the issue within next 15 days.

Advocate Sunil Ranjan Singh had filed the petition claiming the impeachment motion was a direct interference with the independent and competent judiciary, as well as against the principle of separation of power, as it was moved considering a verdict made by the court and another sub-judice case.

He had further claimed that allegations made against the Chief Justice were hypothetical.

The lawmakers of NC and CPN-MC had filed the motion against Karki on Sunday, resulting in her immediate suspension.

Meanwhile, it has been learned that Karki would report back to the office on Sunday.
